DARWIN PARTNERS S.L. reserves the right to modify this policy to adapt it to legislative or jurisprudential developments as well as to industry practices. In such cases, the Provider will announce on this page the changes introduced with reasonable anticipation of their implementation.

1. Introduction and Duty of Information
In compliance with Law 34/2002, of July 11, on services of the information society and electronic commerce, we inform you that this domain (thekeytalent.com) is owned by DARWIN PARTNERS S.L. registered in the Mercantile Registry of Madrid, Volume 28.047, Folio 199, Section 8, Sheet M-505415.
THE KEY TALENT, S.L. has adapted this domain to the requirements of Organic Law 3/2018, of December 5, on Protection of Personal Data (LOPDGDD). It also complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons (GDPR), as well as with Law 34/2002, of 11 July, on Services of the Information Society and Electronic Commerce (LSSICE or LSSI).

2. Data Controller
For the purposes of the provisions of the Regulations on the Protection of Personal Data, DARWIN PARTNERS S.L. (hereinafter also THE KEY TALENT or the Provider), with NIF B87189270 and address in Madrid, C/ Velázquez, 47 7º Izquierda, CP: 28001, informs you that the Data Controller of personal data collected in the web contact or candidacy forms is THE KEY TALENT, in order to manage your applications or your candidacies as the case may be.
3. Registration and Processing of Personal Data
The data requested from CANDIDATES in the different recruitment processes are strictly necessary to successfully complete the process, which you communicate to us voluntarily and are intended to analyze and select the profiles of the candidates for the recruitment process and their professional skills based on the requirements of THE KEY TALENT.
The data requested in the CONTACT form are strictly necessary to meet your requests, which you communicate to us voluntarily and are intended to be able to manage the requests based on the products and services of THE KEY TALENT.
4. What information do we collect?
As a CANDIDATE, the data that will be incorporated into the different selection tests, including personal data, are the following:
- Identification data limited to email, name and surname, date of birth.
- Work and academic history.
- Language and other work-related skills.
- Information on your resume, information you provide in connection with your professional interests, and other information about your qualifications for employment.
As a CONTACT, the data incorporated to answer your request are:
- Identification data limited to email, name and message.
5. For what purpose do we process your data?
We use the information described above for the following purposes:
- Provide information on employment opportunities to candidates.
- To answer the requests of the contacts.
- Perform data analysis, such as the assessment of performance and individual abilities, including scoring on work-related skills.
All processing is carried out with human intervention; there is no decision making or profiling that is solely automated.
6. How long will we keep your data?
They shall be kept for a maximum period of 12 months and subsequently destroyed.
We may retain your data to comply with the requirements of applicable law, prevent unlawful actions, resolve disputes, troubleshoot problems, or for the legal deadlines required. Once the processing of your data is not necessary, we will delete and/or block it in accordance with our data retention and deletion policy and the legal limitation periods in accordance with current regulations. After these periods we will destroy your data.
7. What is the legitimacy for the processing of your data?
Pre-contractual and consent: The legal basis for the processing of data of the CANDIDATE is the pre-contractual relationship and the consent for the CONTACT.
Revocability: The consent given for the processing of the CONTACT is revocable at any time by communicating it to THE KEY TALENT in the terms established in this Policy for the exercise of rights.
8. Are there international data transfers?
Due to the scope of action of the controller or the geographical location of some providers, there may be international data transfers that are covered by data protection regulations since the providers adhere to the standard contractual clauses established by the European Commission.
9. Accuracy and Veracity of the Data
The CANDIDATE and the CONTACT are solely responsible for the veracity and correctness of the data sent, exonerating THE KEY TALENT and/or the Provider of any responsibility in this regard. The CANDIDATE and the CONTACT guarantee and respond, in any case, for the accuracy, validity and authenticity of the personal data provided, and undertake to keep them duly updated. The CANDIDATE and the CONTACT agree to provide complete and correct information in the registration or contact form.
10. Exercise of Rights
You can exercise the rights conferred on you by the GDPR free of charge. You have the right to obtain confirmation as to whether THE KEY TALENT is processing personal data concerning you or not and to withdraw consent at any time.
You can exercise your rights of access, rectification, deletion, opposition, portability and limitation of the processing of your data by contacting THE KEY TALENT or the address lopd@thekeytalent.com, accompanying a copy of your ID duly proving your identity, indicating the reference "Data Protection".
The application must include: name, surnames and photocopy of your ID, request specifying your petition and address for the purposes of notifications.
In case of not being satisfied with the response of THE KEY TALENT to the exercise of your rights, you have the right to claim before the Control Authority, the Spanish Agency for Data Protection (www.aepd.es).
11. Acceptance and Consent
The CANDIDATE declares to have been informed of the conditions on the protection of personal data, accepting and consenting to the processing thereof by THE KEY TALENT in the manner and for the purposes indicated in this privacy policy and in the forms or channels where they are collected provided by THE KEY TALENT.
